Trade Union Membership Will Become Essential Content Of The Contract of Employment

The essential content of the Section One Statement, which must be given to all workers on or before day one of employment, will be extended to include Trade Union Membership.

Proposed Changes

Under the current regime employees have right to join a trade union at any workplace, whether or not the union is recognised. Under the new legislation new and existing employees must be reminded of the right to join a trade union on a “regular” basis.

Timescales

This change may be implemented relatively quickly because primary legislation is already in place. As we saw with the Covid pandemic, secondary legislation can be implemented relatively quickly.

Top Tips

Contracts of employment will need amending to reference the right to join a trade a union. A process for reminding workers, on a regular basis, that they have the right to join a trade union will need to the designed. What constitutes “Regular” notification is not yet defined.
